Canning Across America – Terms Of Service

This website https://canningacrossamerica.com/ (“Site”) is provided by Canning Across America as an informational and community resource, in order to provide information regarding (and to encourage) canning and preserving.

1. License. The Site, and all materials accessible on the Site (“Materials”) are provided for informational purposes and you may use the Site and any Materials for your own personal (non-commercial) use. The Site and Materials are not in the public domain, and you do not have a license to commercialize or exploit the Site or Materials without permission of the applicable rights holder.

2. No Warranties. We do not make any warranties regarding the Site or Materials, including any instructions provided on the Site. The Site and Materials are provided “as is,” and you should not rely on the Site or Materials in the course of your own canning or other activities. You should consult with other resources or use your own independent judgment. Similarly, we do not endorse or make any warranties with respect to any links on the Site or in the Materials, or any activities suggested or organized on the Site, or by other end users of the Site.

3. Code of Conduct. The Site may allow for commenting, sharing, or other interactivity. When you comment or otherwise interact with other users of the Site, you agree to play fair, and not to engage in any conduct or interaction that is harassive, obscene, or otherwise injurious, either to the interests of other users, the Site, or those who operate the Site. We reserve the right to ban any users at our discretion.

4. Infringement Notification. If you are a copyright or other intellectual property owner and feel that any content in the Materials or the Site infringe on your intellectual property, please send us a notice identifying the potentially infringing material, and additional details, as specified in our DMCA/Infringement policy, which you can find here.

5. Governing Law/Venue. Any dispute relating to your use of the Site or Materials shall be resolved under Washington law, in Seattle, Washington, by mandatory and binding arbitration. The arbitration will be conducted with one single arbitrator presiding, under the rules of the American Arbitration Association. You waive your right to proceed in court (and to have a jury trial), and consent to the exclusive jurisdiction and venue in Seattle, Washington.

6. Changes to the Terms. We reserve the right to revise these terms at any time. Any such change will be prospective only. Click on the terms when you access the Site to see when the terms have been last revised – we will indicate any revisions to these terms on the top, next to “Last Revised.”

Community Guidelines

These rules apply both to posting your own content and comments or replies you post to others.

Be respectful!

Site has a zero tolerance policy for racist, sexist, homophobic, xenophobic or otherwise discriminatory language. On Site, there is no place for name calling or vulgar or obscene language (that includes masked profanity, e.g., F$%#).

The people on Site are your neighbors. Treat them as such. Always use clean and civil language, even in heated debates.

Thank your neighbors when they post something helpful, informative or kind. If you think any post is out of line, flag it to notify the Site moderation team.

Threats and harassment are prohibited. That includes threats of physical harm against any group or individual.

No advertisements for (or links to) junk mail, spam, chain letters, pyramid schemes or similar forms of solicitation.

Submission Guidelines

Would you like to submit a story/essay/photo essay to us for publication on this site? Yay! We are so glad. We love to get stories from folks about their experiences with canning and preserving.

Guidelines to help your submission go through our process with the least amount of trouble:

1. Submissions should have something to do with the canning and preserving of food. Other than that, the sky’s the limit. We have essays about canning with family, teaching others to can, how to host a canning party, picking fruit or vegetables for canning, and how to preserve food in other ways, such as drying or fermenting, as well as many more topics. Be creative! We currently don’t have a limit on how long or short submissions should be–but take a look at the essays that are already on the site to get a sense of what other people have done.

2. Please spell check your essay and, if you are unsure if it is properly edited, get someone you know to look it over for you. This site is a labor of love on the part of volunteers and we don’t have the person-power or time to rewrite or do major edits for you.

3. Submission should be original and not an exact copy of one that is on your site or some other site.

4. Submit essay as a Word document written in a standard font attached to an introduction email. Do not submit it as part of the text of your email–this makes it hard for us to get it up on the site.

5. Submit photos as attachments to the email. Again, do not include the photos within the text of your email.

6. Essays should include at least one photo. If you include one photo, we will put it at the top of the essay. If you submit more than one, please tell us where the photo should go within the text of your essay. For example:

Also, please don’t ask us to decide where the photos should go. It’s your essay and you are the best judge of this.

7. Include URLs of any places or web sites that you mention.

8. If you include a recipe, it should be your own original recipe or a recipe for which you have gotten proper permission to publish. Recipes from books cannot be published on this site unless we have permission from the publisher to do so. NOTE: Recipes should also conform to current USDA guidelines. Please do not submit recipes you have created if you are not a master canner/extremely experienced and truly know what you are doing. You need to have checked that your recipe is safe and conforms to proper pH guidelines.

9. Include a short bio of yourself, including your first and last name (unless you just want to be known as your first name), along with links to any websites you have.

10. Submit your essay/photos/photo essay via email to: editor@canningacrossamerica.com.

DMCA/Infringement Notification Policy

This constitutes the policy of Canning Across America with respect to complaints of copyright, trademark, or other intellectual property infringements which occur on the website.

Digital Millennium Copyright Act (Copyright Infringement) Notification:

To file a copyright infringement notification, you will need to send us a communication that complies substantially with the following:

1. Your communication to us should be in writing, and sent by regular mail, fax, or electronic mail.

2. You should identify in sufficient detail the copyrighted work that you believe is being infringed. For example, if the work appears on a web page, a description of the work and a URL would be appropriate. If the work is a book, the title of the book, the author, and the ISBN number would be sufficient identification.

3. You should identify the material that you claim is infringing, and information reasonably sufficient to permit us to locate the material. Providing URLs is the best way to help us locate content quickly.

4. You should provide us with information reasonably sufficient to permit Canning Across America to contact you, such as an address, telephone number, and, if available, an electronic mail address.

5. You should include a statement that reads substantially as follows: “I have a good faith belief that use of the copyrighted material as I have described in this notification is not authorized by the copyright owner, its agent, or the law. The information in this notification is accurate, and I swear under penalty of perjury, that I am the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly being infringed. I consent to personal jurisdiction in Seattle, Washington in order to resolve any dispute relating to this notification.”

6. The notification must be signed by the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly being infringed.

Any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter-Notification:

The alleged infringer may elect to send us a counter notice. To do so, you must send us a communication that complies substantially with the following:

1. The communication should be in writing, and sent by regular mail, fax, or electronic mail.

2. You should identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

3. You should include a statement that is substantially as follows: “I swear under penalty of perjury that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

4. You should provide your name, address, telephone number, email address, and a statement that you consent to personal jurisdiction in the judicial district in which the person who provided notification is located (and in Seattle, Washington), and that you will accept service of process from us or from the person who provided us the original notification.

5. The counter notification must be signed by you.

Other (Non-Copyright) Intellectual Property Infringement

Other (non-copyright) notices of potential infringement should include a statement as to the intellectual property or right potentially infringed, proof of ownership of the rights at issue, identification of the URL at which the potentially infringing material may be found, and a street address, telephone number, and email address where you can be reached. The notice should be in writing, and sent via regular mail to the following address:
